Munarish SmartAssess

Terms of Use

Effective date: [to be set at launch] · Version: 0.8 (draft for legal review)

These terms are an agreement between you and Munarish Academy, 5/446, 4th Street, Kumaran Nagar, Mannivakkam Extension, Vandalur, Chennai 600048, Tamil Nadu, India (GSTIN 33FMKPB4755A1ZF) ("Munarish", "we"). By creating an account or using Munarish SmartAssess ("the app") you agree to them. Please also read our Privacy Policy, the AI and Marking Disclaimer, the Content and Copyright Policy and the Refund and Cancellation Policy. They form part of these terms.

1. Who can use the app

You must be 18 or older to create an account. If you add a learner who is under 18, you confirm that you are their parent or legal guardian, or a teacher authorised by their parent or guardian, and that you agree to these terms for them. You are responsible for how learners use the app under your account.

2. What the app does

The app helps you create practice question papers from study material you upload, and gives AI-assisted marking and feedback on handwritten answers. It shows each learner's progress over time, measured against their own earlier results. It is a learning and self-assessment tool for school, college, competitive-exam and self-directed learners.

You choose the AI level (Standard, Advanced or Expert) used to make each paper and to mark each set of answers. We provide the AI through our own account with our AI service provider. You do not need an account with any AI company. We may update the AI model behind a level as better ones become available.

It is not an official examination, and it is not connected with, endorsed by or approved by any examination board. CBSE, ICSE/ISC (CISCE), Cambridge IGCSE, State Board names and other board names are trademarks of their owners. They are used only to describe the style of paper.

3. Your account

Keep your sign-in methods secure. You are responsible for activity on your account. Tell us promptly if you think someone else has accessed it. We may suspend an account that is being misused, or to protect other users or the service.

4. Your content

  • You keep all rights in the material you upload and in your answers.
  • You give us permission to store, copy, process and transform your content only to provide the app to you (for example: to read it, index it, create papers, mark answers, and make PDFs). This permission ends when you delete the content, subject to the retention periods in the Privacy Policy.
  • You confirm that you own, or have the right to use, any material you upload, for your own study or teaching. Do not upload material you are not allowed to use. Your knowledge bank is private to your account or workspace. We do not publish it or share it with other users.
  • Question papers and feedback created for you are yours to use for personal or teaching purposes.
  • The shared bank. Questions and answer keys the AI writes for your papers may be kept, without your name or answers, and used in papers for other learners of the same book, syllabus topic or printed question paper; papers made with them use fewer papers from your balance. You agree to this, and that questions from the bank may appear on your papers (never one you have already had). Your answers, results and study material are never shared. You can report any question; a reported question is no longer given to anyone.

5. Acceptable use

Do not use the app to: break the law; upload content that infringes others' rights, or that is obscene, hateful, harmful to children, or malicious (such as malware); try to get around limits, trials or payments; access other users' data; copy, reverse-engineer or overload the service; or misrepresent a practice paper or AI mark as an official board paper or result.

6. Free trial, plans, paper packs and payment

  • New accounts may get a free trial of 3 short question papers (each with one marking) at the Standard level. Trial papers are a short sample of your chosen pattern (up to 2 questions for each mark value, up to 8 questions). Each person gets one trial. We may change or end the free trial for new accounts at any time. The free sample tour is always available.
  • After the trial, continued use needs a paid plan. Each plan includes a number of papers per month (fair use). Unused plan papers do not carry over.
  • One paper = one question paper made + one answer sheet marked, at Standard level, for a normal-size paper. Advanced uses 2 and Expert 4. Large papers count double. The app shows exactly how many papers a job will use before you confirm, and you are never charged more than that.
  • Several papers at once and partial answers: you can make a set of papers (e.g. one per subject) or a combined paper, and upload answers for several papers in one scan. You can answer some questions now and the rest later. Marking is charged in proportion to the questions you submit (at least ¼ paper each time). The app shows the total before you confirm.
  • Hourly batch: if you don't need results straight away, choose "Hourly batch". Your request is sent at the top of the next hour and uses half the papers. Results usually arrive within 1–2 hours, but can take up to a day. If a batch fails, the papers are given back.
  • Explain more and challenges: you can ask follow-up questions about a marked answer (3 free per paper, then ¼ paper each) and ask for a second look at a mark (3 free per paper at Advanced level, then ½ paper; always free if the AI was wrong).
  • Need more? Buy paper packs in the app. Pack papers are valid for 12 months, work with an active plan, and work on all your devices.
  • Purchases are made through Google Play (in the Android app), the Microsoft Store (in the Windows app), or our web checkout (on desktop or the web), and are subject to that channel's terms. Your plan and papers work on all your devices. Subscriptions renew automatically until you cancel them where you bought them (Google Play, Microsoft Store, or Settings → Plan for web checkout). Cancelling stops the next renewal, and you keep access until the end of the paid period.
  • Plans include fair-use limits (for example, papers per month), which are shown in the app. These limits keep the service affordable and available for everyone.
  • Papers have no cash value and cannot be transferred. If a paper or marking fails because of a fault on our side, the papers (or trial use) are given back automatically.
  • If our AI provider changes its prices, we may change the papers needed per level, or pack prices, for future purchases and future jobs. Papers you already hold stay valid, and a job you have confirmed is charged as quoted.
  • Refunds: see the Refund and Cancellation Policy.
  • Prices include applicable taxes unless stated otherwise. We may change prices for future periods, with notice in the app.

7. AI output

Questions, answer keys, marks, percentages, correct answers, explanations and references are produced by artificial intelligence and may contain errors. All marks are AI suggestions until a mentor (a teacher, tutor or parent, or you if you are an adult studying on your own) reviews and approves them in the app. Please review them before relying on them, and do not use them on their own for admission, promotion, grading or similar decisions. Please read the AI and Marking Disclaimer, which you accept before your first paper. The app does not replace a teacher.

8. Availability and changes

We work to keep the app available, but we do not promise it will always be uninterrupted or error-free. We may improve, change or stop features, including the AI models offered. If we stop a paid feature you have paid for, we will give a fair remedy, such as a pro-rata refund or extra papers.

9. Ending your use

You can stop using the app and delete your account at any time (Account Deletion Policy). Deleting the app or your account does not cancel a Google Play subscription. Cancel it in Google Play. We may suspend or end accounts that seriously or repeatedly break these terms. Where reasonable, we will first give you notice and a chance to respond.

10. Our intellectual property

The app, its design, software, templates and brand belong to Munarish or its licensors. These terms give you a personal, non-transferable right to use the app. They do not give you ownership of it.

11. Liability

To the extent the law allows: the app is provided "as is"; we are not liable for indirect or consequential losses, or for decisions made on the basis of AI marks or feedback; and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection law that cannot be excluded.

12. Indemnity

You agree to compensate us for losses caused by material you upload without the right to do so, or by your breach of these terms.

13. Governing law and disputes

These terms are governed by the laws of India. Please contact the Grievance Officer first. Most problems can be solved quickly. Courts at Chennai, Tamil Nadu have jurisdiction, without affecting your right to approach a consumer commission.

13A. Using SmartAssess through an organisation

If you use SmartAssess through a school, academy, college or tutor (for example inside its website or portal), your organisation's agreement with us also applies. Your organisation controls your access, roles and data, and may end your access. Purchases are not available in that case, because your organisation pays for your use. Marks you see have been reviewed and approved by your teacher. Questions about marks should go to your teacher or organisation first.
